WASHINGTON (AP) — The Supreme Court on Monday refused to let California clamp down on the sale or rental of violent video games to children, saying governments lack authority to "restrict the ideas to which children may be exposed" despite complaints that the popular and fast-changing technology allows the young to simulate acts of brutality.

Looks like to some people, the ESRB is simply not enough.

When I was a kid I played games like Mortal Kombat (which caused a big stir) Doom, Wolfstein, Killer Instinct, Goldeneye etc etc... and I didnt turn out to be a lunatic or grow up to be a killer.. I dont know what some people think will happen by playing a game. If the parents monitor their childrens behavior and pay attention to them they have nothing to worry.. no reason to go around banning games.

Good. Parents who can't enforce this shit themselves deserve to have their kids exposed to things they object to.

On a more serious note, it is kind of hypocritical - the CEO mentions movies as another form of unrestricted entertainment, and that's obviously not true. And the ban on pornographic magazines and stuff was a good point as well, when you can do much more violent things in video games, just without the exposure of a nipple or two. Based on my own personal beliefs, I agree they shouldn't be restricted, but legally, I would've voted to uphold the law since that makes more sense. In any case, good for California.

Oh and guys I am not saying that they should be banned, but look at the reason why the court says they can't.

It was a stupid law and hard to enforce. Most kids under 18, unless they drive don't have a state ID. So it would be up to the geek working the counter to enforce and there would be discrimination. Also there is no license to sell video games like there is with alcohol and tobacco; therefore no agency to crack down on violators. Instead the local TV stations would be going around with hidden cameras busting store violating the "new law".

Everyone knows older brothers and friends would just go and buy the game for them. As it is few 6 year old walk into a Game Stop and buy a M video game.....they usually get it from their parents.

I was in Gamestop a few weeks back. This mother was in there with her two kids. About 8-10 years old. They wanted one of the Halo games. The mother said fine and was paying for it. The cashier did give the required warning about violence and the M rating. The mother said the best thing ever. "I don't mind my kids seeing animated violence in a game. It beats all of the real sex and violence on TV everyday."

I say we ban the most violent, sexually explict thing in all forms of media, the news.
Seriously though, its all up to the parents to decide. I laugh when I get carded for M games but at least theyre trying to enforce it.

It's just a shame Leland Yee is gonna re-try his attempt to ban violent games in California.

Lord knows why but I've been laughing at that comment hysterically for 10 minutes.

                            Anyway, back to the topic.

That statement makes you wonder why there is an age restriction on movies such as R, NC-17 and pornographic films.

Yeah, that's what I was saying, although I think that may be a standard rule set by theaters rather than a government policy. Although one time when we got yelled out for selling tickets to underage people, I think the manager said it was against the law to let them in or something, but they easily could just be trying to save their own asses. I'm sure if it is an actual law, though, it'll be contested soon enough.

The problem with the United States government (L, E & J branches) is the complete lack of consistency with what is deemed legal and illegal and what age certain people can do certain things.

People have gotten so dependent on the government that it now feels the need to regulate and become involved with as many aspects of your life as possible.

If Leland Yee is going to re-try to ban violent games in California, here's hoping he gets fired for his "efforts", sending him down so low, he'd be lucky if he can find a half eaten Reese's cup!
